HELPING SELL PRODUCTS THROUGH WARRANTY INSURANCE
This client is a leading manufacturer of products used by the downstream oil and
gas industry. Their superior proprietary technology significantly mitigates the
risk of environmental damage for their customers. For years, the
manufacturer sold its products backed by long-term warranties including
environmental clean-up coverage, which in turn was backed by a large insurance
company. However, the insurer notified the manufacturer that, despite no
claims ever being paid, the insurer would be non-renewing the manufacturer's
coverage. Their broker confirmed that there was no other insurer willing
to step in.
Their risk manager and insurance consultant contacted
org to gather information about
Montana's captive insurance capabilities while checking other offshore
domiciles. After a thorough review of tax and strategic considerations as
well as a meeting with captive regulators, Montana was chosen as the captive
insurance company's home. We immediately began writing the captive's
business plan...our client's insurance was soon to expire. The captive's
plan also included writing intellectual property coverage for the client's
proprietary technology, either on a defense or pursuit basis...a coverage that's
very difficult to procure for manufacturers.
Three weeks before the insurer non-renewed coverage, the captive insurance
company was formed and operational, helping our client maintain its competitive
edge and expand into new markets.
